1.1 These general terms and conditions apply to all offers, orders and agreements of Petit Blush that have been concluded with the consumer via distance purchase. These General Terms and Conditions can be consulted at www.petitblush.com. We will send you the General Terms and Conditions on request.
1.2 By accepting an offer or placing an order, the consumer declares to agree with these General Terms and Conditions.
Offers / agreements
2.1 If an offer has a limited validity, Petit Blush will clearly state this.
2.2 Petit Blush will describe its products so accurately and truthfully. Apparent mistakes or errors do not bind Petit Blush.
2.3 Petit Blush will clearly state the rights and obligations of the consumer in its offers when accepting an offer. This includes mentioning the price, delivery costs, payment method and the right of withdrawal.
2.4 Petit Blush is entitled to refuse an order without giving any reason. There is only an agreement once Petit Blush has accepted the order.
Right of withdrawal
3.1 After purchase, the consumer has the right to return an item, without giving any reason, within fourteen days, starting on the day of receipt by the consumer. If an article does not fall under the right of withdrawal due to its nature, Petit Blush will state this in the offer.
3.2 During the trial period, the consumer must handle the product and packaging with care. If the consumer wishes to return an article on the basis of the right of withdrawal, this must be unused, undamaged and in the original packaging. A seal must not be broken. The consumer must ensure proper packaging of the return shipment and bear the shipping costs.
3.3 When returning in accordance with the conditions and within the trial period, Petit Blush will refund the purchase amount within 30 days.
Prices and payments
4.1 All prices for the products or services offered are in euros, including VAT and excluding shipping costs. Shipping costs are listed separately.
4.2 During the stated period of validity Petit Blush will not increase prices, unless there are changes in VAT rates or extreme fluctuations in foreign currencies that are important to Petit Blush.
4.3 Payment must be made using a payment method offered by Petit Blush. Petit Blush cannot be obliged to accept another payment method. Petit Blush is entitled to attach further conditions to the payment. When paying by bank transfer, the day of payment is the day on which the amount is credited to Petit Blush's account.
4.4 Payment must be made immediately after an order. When the amount due has been received by Petit Blush, the order will be processed and processed.
4.5. If the consumer remains in default, Petit Blush is entitled to postpone or dissolve the relevant agreement.
4.6 If you return a sale item and you come under the number of the correct discount code, this will be calculated with the returned amount.
4.7 For discounted items from 40% discount, a voucher for the returned amount will be issued. Items with 60% and 70% discount may not be returned.
4.8 If the discount code is misused, which is not intended for this, the order will be canceled in its entirety and the amount will be refunded to the account known to us.
5.1 The stated delivery times for the products are indicative with a maximum delivery time of 30 days. Exceeding the stated delivery time does not entitle the consumer to compensation or cancellation of the order, unless the delivery time is so long that the consumer cannot reasonably be expected to maintain the agreement. In that case Petit Blush will return the purchase amount to the consumer within 30 days.
5.2 The delivery address is the address provided by the consumer. Petit Blush is not liable for damage as a result of errors or imperfections in the delivery address specified by the consumer.
5.3 Deliveries will only take place to countries specified by Petit Blush. Petit Blush cannot be obliged to deliver to other countries.
Retention of title
6.1 Petit Blush products or services delivered remain the property of Petit Blush until the consumer has fulfilled all obligations under all agreements. The risk of damage or loss is transferred to the consumer from the moment of delivery.
Conformity and guarantees
7.1 Petit Blush ensures that ordered products or services comply with the agreement, the specifications stated in the offer and reasonable requirements of usability and reliability.
7.2 When a product is delivered under warranty given its nature and a defect occurs within the warranty period, the consumer must inform Petit Blush in writing or by e-mail. Petit Blush will take back the article for repair or replace it, provided that the defect has not arisen due to injudicious or improper use. The choice for repair or replacement lies with Petit Blush.
7.3 Warranty is limited to the term set by the manufacturer or supplier of the product.
Complaints and liability
8.1 The consumer must check an article as soon as possible upon receipt. Any defects or transport damage must be reported to Petit Blush in writing or by e-mail within 7 days of receipt.
8.2 After receipt of the complaint, Petit Blush will either replace the items, or refund the purchase price, after returning them.
8.3 If an article does not meet the quality standards that can reasonably be set for it in normal use, the consumer can inform Petit Blush of this in writing or via e-mail and Petit Blush will assess the complaint and, if necessary, the relevant article. repair or replace.
Force of the majority
9.1 Petit Blush cannot be obliged to fulfill an agreement or part of it in case of force majeure. In that case Petit Blush has the right to suspend the agreement, to only partially fulfill it or to dissolve it without compensation for damage to the consumer. This does not release the consumer from the obligation to pay that part of the agreement that has been fulfilled and represents an independent value.
9.2 If the period of force majeure lasts longer than 2 months, both parties are entitled to dissolve the agreement.
Applicable law and competent court
10.1 Dutch law applies to every agreement between Petit Blush and the consumer, even if the products or services have been delivered in whole or in part abroad.
10.2 Petit Blush and the consumer will only appeal to the courts after they have made every effort to settle a dispute in mutual consultation.
